Image licence for property marketing

Between the Owner (the person supplying the images) and the Agent (the agency or professional marketing the property), in respect of the images, videos, drone footage and floor plans the Owner supplies for the property (the Materials).

1. 1. Licence. The Owner grants the Agent a non-exclusive, non-transferable, revocable licence to reproduce and display the Materials solely to market the sale or rental of this property, including on the Agent's website, property portals, social media, print and window displays used for that purpose.
2. 2. No other use. The Materials may not be used for any other property, for the Agent's general branding or advertising, in portfolios or case studies, or supplied to third parties other than portals and co-marketing agencies that the Owner has approved in writing. The Agent may not claim copyright in the Materials or remove any photographer credit or metadata the Owner asks to keep.
3. 3. Alterations. Cropping, resizing, colour correction and the addition of the Agent's watermark or logo are permitted. Retouching that changes the property (removing power lines, adding furniture, altering views or sizes) is not, unless the Owner agrees in writing and the image is labelled as a visualisation.
4. 4. Term and removal. The licence lasts while the Agent's instruction to market the property is live and ends automatically when that instruction ends, the property is sold or let, or the Owner revokes it in writing (including by revoking the MallorcaData photo link). Within seven days of the end the Agent will remove the Materials from every channel under its control and request removal from portals.
5. 5. Owner's warranty. The Owner confirms they hold, or have obtained from the photographer or other author, the rights needed to grant this licence, and that the Materials do not show identifiable people or neighbouring private interiors without consent.
6. 6. Originals. Where the Agent commissions photography of the property, the Agent will provide the Owner with the original full-resolution files and a licence on the terms above, so the Owner may use them with any agent.
7. 7. Law. Spanish law applies. Nothing here limits either party's rights under the Spanish Intellectual Property Act (Real Decreto Legislativo 1/1996).
